"The Law on Free Speech, Politics, and Social Media in the Workplace" with Aaron Holt
What happens when the lines between personal expression and professionalism start to blur and bleed into the workplace? Is off-duty political speech on social media protected or are there circumstances when an employer has a legal obligation to take action?
This session will explore these questions as well as recent changes in the law while providing practical guidance for employers seeking to understand the limits of free speech in the workplace, when employment laws such as Title VII or the NLRA require employer action.
Learning Objectives
1. Describe the legal framework involving employee speech, including the First Amendment, Title VII of the Civil Rights Act of 1964, the National Labor Relations Act, and related state laws along with recent updates to these laws.
2. Discuss example cases from Texas and federal court decisions interpreting what constitutes protected speech.
3. Explore pro-active strategies to minimize the possibility of litigation arising from adverse employment actions or policies relating to social media.
